Eagle Butte Man Pleads Guilty to Assault

U.S. Attorney Brendan V. Johnson announced that Nelson Miles Red Bird, age 21, of Eagle Butte, appeared before U.S. District Judge Roberto A. Lange on March 15, 2011, and pled guilty to count 1 of the indictment that charged him with Assault With A Dangerous Weapon. The maximum penalty upon conviction is 10 years' imprisonment.

The charge stems from the assault and injury of two people in Eagle Butte in June 2010. The investigation was conducted by the Cheyenne River Sioux Tribe. The case is being prosecuted by Assistant U.S. Attorney Marie H. Ruettgers.

A presentence investigation was ordered, and a sentencing date was set for June 6, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
